Terms & Conditions

In these Terms and Conditions "we", “our” and "us" mean Innova Oz Trade, with ABN 96 490 883 903, and "you" means you, the customer. These Terms and Conditions together with your Order constitute the entire Contract between us and you for the supply of Products. 

Legal Capacity of Purchase
You must be over the legal age of eighteen (18) years old to place an order with us.
Should Innova Oz Trade suffer any damage or other losses as a result of a transaction entered into by a minor, we reserve the right to pursue compensation for such losses from the parents or guardians of the minor who initiated any order(s) with us.

Proof of purchase
Merchandises are invoiced at the time of the purchase and/or provisioning and include GST and delivery fees where applicable.

Claims
Claims must be made in writing to us within 7 days of delivery. Any costs incurred or loss suffered by Innova Oz Trade in respect of any unauthorised return by the customer, may be deducted from any credits granted to the Applicant or supplemented to cost to the then amount remaining.

Credit Terms
We do not offer any form of credit. Payment must be made immediately after order or purchase.

Disputes
Any disputes with the Innova Oz Trade shall be subject to the Laws and Courts of the State of South Australia.

Retention of Goods
Until the merchandises are paid for in full they will remain in our control, however the risk will pass to the customer in the case if goods are not collected at a set time.

Placing Wholesale Order 
Your Order will be placed by filling in the Order Form on Innova Oz Trade Web Site.
After you have placed your Order, we will issue you with an Order Number and send it to you via email. By placing an Order, you are committing to purchase the Products you have selected based on agreeing with our Terms and Conditions. 
Innova Oz Trade will make every effort to supply Products to you. We will notify you that your order is being processed by sending you an Order Confirmation and tax invoice via email. However, we do not formally accept your offer until your order has been approved. We and our affiliates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our discretion. 
We will confirm acceptance of your order when we send you an email confirming consignment of the merchandises you have ordered. 
If we cannot process or accept your Order after payment is received we will contact you by email or telephone.

Payment 
We currently accept Visa, MasterCard, PayPal and Bank Deposit. Payment processing will not begin until we receive all the information we need. 

Orders placed on a weekend or a Public holiday will not begin payment processing until the next business day.
When you make a purchase you must pay the price payable in Australian dollars as indicated on your Order Confirmation within 3 days from the date that you receive your Order Confirmation. 

If a Bank Deposit payment is not received within 7 days from the date that you receive your Order Confirmation, We reserve the right to cancel the transaction. 

For credit card and Bank Deposit payments a tax invoice will be emailed out to you with your Order Confirmation. Where you pay by Bank Deposit a tax invoice will be sent to you via email after your payment has been confirmed by the corresponding financial institution. Your tax invoice is your proof of purchase.

In the case of a pre-order, a prepaid amount of 100% of the invoice price must be paid when placing the initial order.
The balance of the invoice price must be paid in full before any delivery is organised.


Please Note:

  • We are unable to accept credit cards issued by banks outside of Australia.
  • Debit cards and cheque cards have daily spending limits that may substantially delay the handling of your order.
  • You may be required to provide further identification for supplementary security reference checks.

GST
Innova Oz Trade purchases include GST.

Prices
We are importers and this gives as a place to provide you with the most competitive prices.  Innova Oz Trade reserves the right to change prices for Products displayed at Innova Oz Trade site at any time before you place an Order (catalogue or online). The price of products shown excludes shipping costs. Shipping cost is quoted at the time of check out but may be recalculated based on quantity and distance.

Supply of Your Products
Subject to these Terms and Conditions, we will supply to you the products indicated on your Order Confirmation. When your Order items have been dispatched, we can email you to confirm shipment of each item.

Delivery 
Delivery time takes up to 10 working days from the date your payment is received. Please note that Bank Deposit payments take 1-2 business days to process. In all instances estimated delivery times will be displayed at the checkout for your product. Innova Oz Trade makes every effort to deliver your product according to the estimated delivery times provided by Innova Oz Trade at checkout. 

The estimated delivery times are in business days (Monday to Friday) excluding public holidays. Although every effort is made to ship your Order according to the estimated delivery times provided, estimated ship times may change due to changes in supply or circumstances beyond our control. 

If your product has not arrived after the estimated delivery time, please contact us here. Unless otherwise agreed by us, we will deliver your products to the address indicated on your Order Confirmation.

The Customer must, within 5 days of being notified of their availability, collect or accept delivery of the Goods and pay the balance of the invoice price.

If the Customer fails to accept delivery of the goods within 21 days of being notified of their availability, the Company may terminate this contract, retain the payment made and resell the Goods.

In addition, the Company reserves the right to charge the Customer storage on goods not collected or delivered within 5 days of notification of availability at the rate of $15.00 per day.

The Company reserves the right to deliver the Goods in whole or instalments, as well as to deliver prior to the date for delivery and, in such events, the Customer must not refuse to take delivery of the Goods.

Any failure on the part of the Company to deliver instalments within any specified time does not entitle the Customer to repudiate the contract with regard to the balance remaining undelivered.

If no-one is available to take delivery of your products,our carrier will either be carded or your order can be left at your front door. Where delivery is by our courier service and no-one is available to take delivery, they will leave a card requesting you to telephone them to arrange a suitable time and date for delivery. We will use our reasonable efforts to deliver your products to you within the estimated delivery time indicated on your Order Confirmation. We do not guarantee that we will deliver within this time frame. Title and risk of loss to all products will pass to you on delivery.

Shipping
We want your products to arrive quickly and at the best shipping rate we can offer. Shipping charges are calculated based on product size and the geographical region of the delivery address. 

Estimated shipping charges from our Adelaide Distribution Centre are based on product size and delivery zone.

Consumer Guarantees
All our products go under quality control before sold.

Consumer guarantees apply under the Australian Consumer Law. Nothing in these Terms and Conditions excludes the application of those guarantees. For more information about your rights as a consumer, see the Australian Consumer Law website at http://www.consumerlaw.gov.au. If a Product has a minor defect, we may provide a repair or offer you a replacement or a refund subject to company approval. If a Product has a major defect, you are entitled to:

 

  • Reject the goods and receive a refund 
  • Reject the goods and receive an identical replacement, or one of similar value if reasonably available, or 
  • Keep the goods and receive compensation for the drop in value caused by the problem.

If you think that a Product is defective you should contact us and an Innova Oz Trade Customer Service Representative will assist you. A photo may be requested to assist with the assessment of your claim.

Cancellations
No order may be cancelled, modified or deferred without the prior written consent of the Company (which is at the Company’s sole discretion). If such consent is given it is, at the Company’s election, subject to the Company being reimbursed all losses, including loss of profits, and paid a cancellation fee (being not less than 20% of the invoice price of the Goods).

Returning a Product
Freight is the responsibility of the buyer returning the goods. Please contact us at sales@innovaoztrade.com.au for a return authorisation number.

Where Customer Service has provisionally determined that a Product is defective, Customer Service will advise you on returning the goods.
Where possible, all products should be packed in the original, unmarked packaging including any accessories, manuals, documentation and registration that shipped with the product. If the complete contents are not included, only a partial refund will be applied. 

Credit Card Fraud
While Innova Oz Trade will not be accountable for any damages, consequential losses (whether direct or indirect) suffered by a customer whose credit card is fraudulently used or used in an unauthorised manner.

Fraud Protection or Prevention Procedures
When you place your Order by either a Credit Card or Bank Deposit you may be sent an email from our Fraud Prevention Officer requesting further information, such as a copy of your credit card and driver’s license or passport for identification. After authentication of this information, it will be destroyed. 

In this case, until your order has passed internal Fraud Prevention procedure checks your order will remain on Pending status. If you do not provide the requested information within 7 days, your order will be cancelled and your payment will be refunded back to the method in which you paid. 

These information requests are sent to help protect Credit Card account holders from online fraud.

General
You shall not assign any rights and obligations under these Terms and Conditions whether in whole or in part without the prior written consent of us. Any unauthorised assignment shall be deemed null and void. We withhold the right to change the Terms and Conditions of sale at any time. The Terms and Conditions applicable to you are those on our website at the time you order a product.

Force Majeure
To the degree permitted by law, we are not liable for any delay in performing any of its obligations under these Terms and Conditions if such delay is caused by circumstances beyond the reasonable control of Innova Oz Trade, and Innova Oz Trade shall be entitled to a reasonable extension of time for the performance of such obligations.

Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Commonwealth of Australia and shall be subject to the non-exclusive jurisdiction of the courts of South Australia.
